Terms and Conditions of Sale

Art. 1 – General Provisions

  1. These Terms and Conditions of Sale govern the purchase of products offered on The Prism website, accessible at https://club.theprism.com and/or through other official domains connected to The Prism.

  1. By browsing the website and placing an order, the user accepts these Terms and Conditions of Sale, as well as the policies published on the website, including the Privacy Policy.
  2. The user is invited to carefully read these Terms and Conditions of Sale before making any purchase and to save or print a copy.
  3. The Prism reserves the right to amend these Terms and Conditions of Sale at any time. Any changes shall be effective from the moment they are published on the website and shall not apply to orders already confirmed.
  4. The website may be used in English. These Terms and Conditions of Sale may also be made available in Italian. In case of translations into other languages, any interpretative differences shall be assessed based on the version published on the website at the time of purchase.

Art. 2 – Scope

  1. These Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders for products sold by The Prism through the website.
  2. These Terms do not govern the sale of products or services by third parties that may be present on the website through links, banners or other hyperlinks. Before purchasing products or services from third parties, the user is invited to consult their respective terms and conditions.

Art. 3 – Products Offered

  1. The Prism sells artworks, editions, artistic objects and products connected to The Prism project, made in different formats, materials and configurations.
  2. The main characteristics of the products are described in the relevant product pages available on the website.
  3. Product images are for illustrative purposes only. Minor differences in colour, visual rendering, finish or perception of materials may depend on the device used by the user, screen settings or the physical and artisanal characteristics of the product.

Art. 4 – Conclusion of the Contract

  1. To make a purchase, the user must select the desired product, add it to the cart and complete the checkout process by entering the required information.
  2. Before confirming the order, the user will be able to review the summary of the selected products, the price, any applicable taxes, shipping costs, billing and delivery details and the selected payment method.
  3. The order is submitted when the user completes the checkout process by clicking the order confirmation button, such as “Place Order”, “Pay now”, “Buy” or any equivalent wording.
  4. The sales contract is considered concluded when The Prism receives the order and sends an order confirmation to the email address provided by the user during the purchase process.
  5. The Prism reserves the right not to accept or to cancel an order in case of incomplete or incorrect data, product unavailability, obvious error in the price or information published, suspected fraudulent use of payment, or other objective reasons preventing fulfilment of the order. In such cases, the user will be informed and, if payment has already been made, will receive a refund of the amount paid.

Art. 5 – Prices

  1. All prices published on the website are expressed in Euros, unless otherwise indicated.
  2. Prices include VAT where applicable.
  3. Shipping costs are not included in the product price, unless otherwise indicated, and are calculated and shown separately during the checkout process before the order is confirmed.
  4. For orders delivered to countries outside the European Union, any customs duties, import taxes, local charges, customs clearance fees or other amounts required by the competent authorities or by the carrier are not included in the product price nor, unless otherwise indicated, in the shipping costs, and shall remain the responsibility of the buyer.
  5. The Prism reserves the right to change prices at any time. Changes shall not apply to orders already confirmed.
  6. In case of an obvious error in the price published on the website, The Prism will inform the user and allow the user to confirm the order at the correct price or cancel the order and receive a refund of any amount already paid.

Art. 6 – Payment Methods

  1. Payment may be made using the methods available at checkout, including, by way of example:
  • credit cards;
  • debit cards;
  • PayPal;
  • bank transfer, where available;
  • any other payment methods enabled on the website.
  1. Available payment methods may vary depending on the user’s country, currency, device used or payment platform settings.
  2. In case of payment by bank transfer, the order may be fulfilled only after the amount due has been credited.
  3. The Prism does not directly store full payment card details, which are handled by payment service providers according to their respective security standards.

Art. 7 – Product Availability

  1. Product availability shown on the website refers to availability at the time the user views the product.
  2. Since the website may be visited simultaneously by multiple users, product availability may change before the order is confirmed.
  3. If an ordered product is unavailable, The Prism will inform the user by email and, where possible, offer one of the following solutions:
  • waiting for restock or availability of the product;
  • replacement with another product, subject to the user’s consent;
  • full or partial cancellation of the order;
  • refund of the amount paid for the unavailable product.
  1. In case of order cancellation due to product unavailability, The Prism will refund the amount paid within 14 days from the communication to the user.

Art. 8 – Shipping and Delivery

  1. The Prism ships to the countries available at checkout. Shipping availability may vary depending on the destination country, purchased product, carrier and any logistical or customs restrictions.
  2. If a country is not available at checkout, the order cannot be automatically completed for that destination. The user may contact The Prism at support@theprism.com to verify the possibility of a custom shipment.
  3. Delivery will be made to the address provided by the user during checkout or to any available pickup points selected by the user.
  4. The user is responsible for the accuracy and completeness of the shipping information provided. The Prism shall not be responsible for delays, failed deliveries or additional costs resulting from incorrect, incomplete or outdated addresses provided by the user.
  5. Delivery times indicated on the website or at checkout are estimates only and may vary depending on the destination, carrier, customs procedures and other circumstances not directly controlled by The Prism.
  6. Unless otherwise indicated, The Prism undertakes to deliver the products within a maximum period of 30 days from the order confirmation.
  7. For deliveries to countries outside the European Union, any customs duties, import taxes, local charges, customs clearance fees or other amounts required by the competent authorities or by the carrier shall be borne by the buyer.
  8. Any delays due to customs checks, holidays, extraordinary events, strikes, force majeure or circumstances attributable to the carrier shall not be attributable to The Prism.
  9. If delivery cannot be completed due to the recipient’s absence, incorrect address, failure to collect the shipment or any other reason attributable to the user, any storage, redelivery, return or new shipping costs may be charged to the user.

Art. 9 – Transfer of Risk and Ownership

  1. The risk of loss or damage to the products passes to the buyer when the buyer, or a third party designated by the buyer other than the carrier, physically receives the products.
  2. Ownership of the products passes to the buyer only after full payment of the price, applicable taxes and any shipping costs.

Art. 10 – Right of Withdrawal

  1. If the buyer acts as a consumer, the buyer has the right to withdraw from the purchase contract within 14 days from the date on which the product is received, without giving any reason.
  2. In case of an order concerning multiple products delivered separately, the 14-day period starts from the date on which the last product is received.
  3. To exercise the right of withdrawal, the buyer must communicate the decision to The Prism by means of an explicit statement sent by email to:

The communication must include:

  • buyer’s name and surname;
  • order number;
  • product subject to withdrawal;
  • email address used for the purchase.
  1. The buyer may use the standard withdrawal form provided by applicable law, but its use is not mandatory.

  1. The product must be returned intact, undamaged, in its original packaging, complete with all parts, accessories, certificates, documentation and materials received.
  2. The direct costs of returning the product shall be borne by the buyer, unless otherwise indicated or in case of defective or non-conforming products.
  3. The buyer is responsible for any decrease in the value of the product resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product.
  4. The Prism will refund the amount paid by the buyer, including any standard delivery costs incurred at the time of purchase, within 14 days from the date on which The Prism is informed of the decision to withdraw.
  5. The Prism may withhold the refund until it has received the returned product or until the buyer has provided proof of having sent back the product, whichever occurs first.
  6. The refund will be made using the same payment method chosen by the buyer for the purchase, unless otherwise agreed between the parties.
  7. In case of payment by bank transfer, the buyer must provide the bank details required for the refund, including IBAN, SWIFT and BIC where required.
  8. The right of withdrawal does not apply in the cases provided for by applicable law, including, by way of example, products made to measure, personalised products or products made according to the buyer’s specific requests, where such exception is applicable.

Art. 11 – Legal Guarantee and Conformity

  1. The Prism is liable towards the consumer for any lack of conformity of the products sold, within the limits and according to the provisions of applicable law.
  2. In case of a defective, damaged or non-conforming product, the buyer must contact The Prism at:

indicating:

  • order number;
  • description of the issue;
  • photographs of the product, packaging and any damage found;
  • any other information useful for verification.
  1. In case of an ascertained lack of conformity, the consumer shall be entitled to the remedies provided by applicable law, including, where possible, repair, replacement, price reduction or termination of the contract.
  2. Return costs relating to defective or ascertained non-conforming products shall be borne by The Prism.
  3. Minor differences in colour, finish, texture, visual perception or material rendering resulting from the technical, artistic or production characteristics of the product shall not be considered lack of conformity, unless such differences make the product substantially different from what is described in the product page.

Art. 12 – User Account

  1. Purchasing on the website may require or allow the creation of a customer account, depending on the features available on the platform.
  2. The user undertakes to provide correct, complete and updated data.
  3. The user is responsible for keeping any access credentials confidential and undertakes not to disclose them to third parties.
  4. The Prism shall not be responsible for any unauthorised access resulting from improper use, loss or disclosure of the user’s credentials to third parties, except in cases of liability directly attributable to The Prism.

Art. 13 – Processing of Personal Data

  1. The user’s personal data are processed in accordance with applicable personal data protection laws, including Regulation EU 2016/679, as described in the Privacy Policy published on the website.
  2. The user is invited to consult the Privacy Policy before making a purchase.

  1. The Prism undertakes to respond to user requests within a reasonable time, depending on the nature of the request.

Art. 15 – Limitation of Liability

  1. The Prism shall not be liable for any service interruptions, delays or impossibility of performance resulting from force majeure, unforeseeable events, strikes, transport service disruptions, customs issues, payment service unavailability, technical malfunctions of the platform or events not directly controlled by The Prism.
  2. The Prism shall not be liable for any indirect damages, business losses, loss of profits or other consequences not directly connected to the purchase of the product, within the limits permitted by applicable law.
  3. The mandatory rights granted to consumers by applicable law remain unaffected.

Art. 16 – Severability Clause

  1. If one or more provisions of these Terms and Conditions of Sale are deemed null, invalid or ineffective, in whole or in part, such nullity, invalidity or ineffectiveness shall not affect the validity of the remaining provisions.

Art. 17 – Applicable Law and Jurisdiction

  1. These Terms and Conditions of Sale are governed by Italian law, without prejudice to any mandatory provisions provided by the law of the consumer’s country of habitual residence.
  2. Any dispute relating to the interpretation, performance or termination of these Terms and Conditions of Sale shall be subject to the jurisdiction provided by applicable law.
  3. If the buyer qualifies as a consumer, the mandatory jurisdiction of the court of the consumer’s place of residence or domicile, where provided by applicable law, shall remain unaffected.
